Terms and Conditions for Digital Feng Shui - Fundamentals

1. Agreement to Terms

By purchasing, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use the Service.

2. License and Access

2.1. License: Subject to your compliance with these Terms and your payment of all applicable fees, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and view the Course content for your personal, non-commercial, educational use.

‍2.2. Lifetime Access: Your purchase grants you "Lifetime Access" to the Course materials.

• Definition: "Lifetime Access" refers to access for the lifetime of the Course. This means as long as Digital Feng Shui continues to host and make this specific Course available, you will have access.
• Exclusions: This "Lifetime Access" applies only to the version of the Course purchased. It does not grant you any rights to future courses, new product offerings, add-on modules, premium updates, or other products or services, which may be sold separately.
• Discontinuation: We reserve the right to retire or discontinue the Course at any time. If we do so, we will provide at least 90 days notice to all active users.

3. User Accounts

To access the Course, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and login credentials.
• Not share your account login credentials with any other person.
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activities that occur under your account. Granting access to your account to another person is a material breach of these Terms and may result in the immediate termination of your access.

4. Payments

You agree to pay the fees for the Course as listed on the Site at the time of purchase. All payments must be made in full at the time of purchase through our designated payment processor. You agree to provide current, complete, and accurate purchase and account information.

5. Refund Policy

All sales are final. We do not offer refunds, returns, or exchanges.

You acknowledge and agree that upon purchasing the Course, you receive immediate access to the digital content and intellectual property. Due to the low-cost, practical nature of the Course and the fact that the full value of the content can be consumed immediately or in a very short period, we cannot and do not offer any form of money-back guarantee or refund.

By completing your purchase, you expressly consent to the immediate performance of this contract and acknowledge that you will lose any statutory right to withdrawal or a "cooling-off" period that might otherwise be applicable. You understand that this policy is fair and necessary to protect the value of the Course.

6. Intellectual Property

All content included in the Service, such as text, graphics, logos, videos, audio, guides, templates, and software (the "Content"), is the property of Digital Feng Shui or its content suppliers and is protected by copyright and other intellectual property laws.

You agree not to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and login credentials.
• Not share your account login credentials with any other person.
• Notify us immediately of any unauthorized use of your account.

7. Prohibited Conduct

You agree not to use the Service in any way that:

• Is unlawful, fraudulent, or harmful.
• Harasses, abuses, or harms another person.
• Violates the intellectual property or other rights of any third party.
• Attempts to gain unauthorized access to our systems or another user's account.

8. Disclaimers

8.1. For Educational and Informational Purposes Only: The Course is provided for educational and informational purposes only. We make no representations, warranties, or guarantees regarding any specific results, success, or outcomes (whether professional, financial, or otherwise) from your use of the Service. Any testimonials or examples shown are not a guarantee of your own results.

‍8.2. "As Is" Basis: The Service and all Content are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

9. Limitation of Liability

To the fullest extent permitted by law, in no event will Digital Feng Shui, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, use, or goodwill) arising from your access to or use of, or inability to access or use, the Service.Our total aggregate liability to you for all claims arising from the Service is limited to the total amount you paid us for the Course.

10. Indemnification

You agree to defend, indemnify, and hold harmless Digital Feng Shui from and against any and all claims, damages, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; or (ii) your violation of any term of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the Course will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands,
without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
